Pennsylvania Commonwealth Court Reaffirms Independent Contractor Rule

The Pennsylvania Commonwealth Court reaffirmed the right of control test after an independent contractor hurt on the job filed for workers compensation. The two main considerations making up the right of control test are an analysis of the extent of control an employer has over the worker and the manner in which the contractor was to perform the work. Failing the right of control test means that a worker is not entitled to receive workers compensation benefits because there is no employee-employer relationship.
